Don't be pressured to start work on-site before you've even signed the Contract

All too often Contractors manipulate and pressure Sub-Contractors to start work on site prior to the acceptance of proper Contract Terms. Don't just agree to this without knowing the risks!

Would you expect a car dealer to let you drive away in a brand new car without getting you signing the finance agreement?

Probably not, but a similar scenario happens every day when Sub-Contractors begin work on new projects without even agreeing the terms of their engagement! When you do this, it means you've got absolutely no guarantee you'll ever see a penny for the services you've 'sold'!

In our experience, these scenarios usually stem from a Contractor who is under pressure from the Client because of their own procurement failures. They wait too late to appoint Sub-Contractors and jeopardise their own projects, and Sub-Contractors are expected to take the risk to get them back on track.

In fact, we find that Contractor's blame Sub-Contractors for delays on projects before the Contract has even been signed! This is absurd and completely unreasonable, but it happens more than you think.

Push-back and protect your own interests first

In an ideal world, we say don't find yourself mobilising on to the site without first confirming, agreeing and executing the Contract to incorporate such things as necessary and achievable start dates, mobilisation periods and completion dates. You shouldn't be made to feel under pressure - remember the Contractor needs you!

The Contractor's 'need' doesn't become your 'must' just because the Contractor is late. So take steps to protect yourself, even if you are required to start before signing a contract - but don't leave it too late to come to ask for expert advice.
